Terms & Condtions
Following definitions apply in this agreement unless the context requires otherwise:
- The Company means Melbourne Maxis.
- Hirer shall deemed to be the person who has agreed or signed or the person responsible for the payment of the hire.
- Hire shall be the period for which the vehicle has been hired or has been reserved for.
- Employee means any employee of the company, including a driver or chauffeur employed by the company or agency contracted by the company.
- Booking means a period for which the hirer has committed to the hire.
- Deposit shall be 50% of agreed fee.
- Balance means the amount due under the terms of this agreement, less the deposit paid.
a) In the event of a mechanical breakdown or accident while on hire, or during the time traveling to the collection of the hirer the company shall not be held liable. The company shall endeavour to make alternative arrangements to get the hirer to their destination and it shall be the company’s absolute discretion to determine the method of onward travel. If the hirer chooses to make alternative arrangement, this shall be at the cost of the hirer and the company shall not be held liable nor any claim be made against the driver and/or company by the hirer.
b) The hirer acknowledges and accepts that no specific guarantee can be made in terms of time, reliability of the vehicle and/or events out of the control of the driver and/or company. The hirer shall not hold the company liable nor make claim against the driver and/or company for this purpose.
c) The hirer acknowledges and accepts that the hirer can not request a specific vehicle and if such vehicle is unavailable on the day of service due to unforeseen circumstances, the hirer shall not hold the company liable nor make claim against for this purpose.
d) The hirer is required to make immediate payment of the full deposit amount upon confirmation of the booking. In the the event that you cancel the booking, the company reserves the right to charge the following cancellation fees as follows;
- if the hirer makes payment of the deposit amount, the full deposit amount shall be paid back to the hirer if the the confirmed booking is cancelled prior to 48 (forty-eight) hours of the service.
- unless authorised by company management, the full amount of the deposit is non-refundable should the confirmed booking be cancelled within 48 (forty-eight) hours of the service. A charge of 30% of the deposit amount to the hirer shall apply if this takes effect.
- if the confirmed booking is cancelled within 24 (twenty-four) hours of the service, the hirer shall not be entitled to any refund, unless authorised by company management, and shall be requested to pay the full amount of the quoted amount by the company.
e) Extra charges will apply 15 minutes after the scheduled booking time at current hourly rate. It is the company’s absolute discretion to charge the hourly rate for each individual booking.
f) The hirer assumes full financial responsibility for any loss or damage caused by the hirer or his/her guests to the vehicle and/or driver. The company will do whatever it takes to assist the state police during incidents of loss or damage and may require to provide personal details, including name, contact number and address provided of the hirer to the police under necessary circumstances. The hirer shall not object to this in any way nor hold the company liable for this purpose.
g) At any given time, the company reserves the right to cancel, delay or terminate a booking and will not be obliged to reimburse, refund, nor compensate the hirer for this purpose unless instructed by company management. The company may inform the hirer of the cancellation, delay and/or termination by telephone or in writing by email or text and shall not beheld liable if the hirer fails to answer their telephone or neglects to read the written notice.
h) The hirer acknowledges that it is their sole responsibility for any loss or damage of personal items that are left in the vehicle at any given time. The hirer cannot hold seek compensation, reimbursement nor refund for the loss or damage of any such personal items. The company will do whatever it takes to assist the state police during incidents of theft and may require to provide personal details including full name, contact number and address provided of the hirer to the police under necessary circumstances. The hirer shall not object to this in any way nor hold the company liable for this purpose.
i) Beveridge and food consumption is not permitted in vehicles. Any damage to the vehicle or parts thereof as a result shall be the responsibility of the hirer and the hirer accepts and acknowledges that the company may hold absolute discretion to compensation for loss and damages. Smoking is prohibited by law within any of our vehicles. The company reserves their right to take appropriate action in its absolute discretion should any of the passengers be caught smoking within the vehicle.
j) Upon request, baby seats can be provided (subject to availability) and it’s the hirers complete responsibility to ensure that the seat is correctly fitted before placing an infant into the seat. If the hirer does not consider that the seat provides sufficient protection or that is not fitted correctly, the hirer shall not allow the infant to travel. The hirer shall not seek compensation, refund nor reimbursement from the company for this purpose.
k) Any amendments to your booking after receiving confirmation can only be accepted subject to availability. The company reserves the right to amend the quoted amount in respect of the changes to the booking.
l) In the event of payment via credit card, there will be a surcharge of 1.11% additional to the quoted amount.
m) Prices are current at the time of quotation and subject to availability at the time of booking. All quoted prices include GST. The company reserves the right to include, without notice, any increases that may occur in any applicable airport charges, road tolls, entry fees or parking charges to the hirer during, before and/or after the service to the hirer.
n) At any given time during or prior to the service, the driver and/or company may terminate and/or cancel the service if the driver and/or company feels the hirer or its guests are endangering the driver and/or any of the other passengers and/or public in the vehicle in any way which may also relate to rude and/or negative behaviour. The hirer agrees and acknowledges that it shall not request compensation, nor seek refund or reimbursement of the amount if termination of the service take effect.
